Book excerpt: This report explores the asymmetry and imbalance of information, experience, and expertise between state government agencies and private contractors. Generally, the contractor has superior information, greater experience, and specialized expertise that gives it an advantage in all stages of the procurement process, including the negotiation period, designing the contract, and contract management. This report specifically focuses on large contracts with values over $10 million in Texas. It analyzes three recent state procurements initiated by the Health and Human Services Commission to explore the effects of this imbalance on contracting outcomes. The report will also provide policy recommendations intended to help improve the procurement process in Texas and help the state become a savvier purchaser of goods and services.
